Revocation instruction

Consumers have a right of revocation for a period of fourteen days.

Right of revocation

You are entitled to revoke this contract within a period of fourteen days without stating any reasons.

The deadline for revocation shall be fourteen days starting from the day, on which you or a third party nominated by you, which is not your carrier, has taken possession of the last partial shipment or the last item.

In order to exercise your right of revocation, you must inform us (Michele Matei, Albrechtring 13, 85298 Scheyern, Germany mail@emilyjoes.com, phone: 08441 7971174) in writing (i.e. a letter sent via post, fax or email) stating your decision to revoke this contract. For this purpose, you may use the attached sample form of revocation, which is however not mandatory.

To protect your right of revocation, it is sufficient to send a letter notifying that you will exercise your right of revocation before the deadline for revocation.

Consequences of revocation

Should you revoke this contract, we are obliged to refund all payments received from you, including the delivery cost (with an exception of any additional cost resulting from you choosing any other delivery method than the standard method offered) immediately and latest within two weeks starting from the day on which we receive the notice of revocation of your contract.

We will use the same method of payment for your refund which you have used for the original transaction, unless we have explicitly agreed on anything else. For this refund, we will not impose any further charges on you. We reserve the right to refuse the refund until the earlier of either receiving all goods from you or receiving proof of returning the goods.

You are required to send or give back the goods without any delay and in any case latest within fourteen days, starting from the day of informing us about the revocation of contract.

The deadline is considered as met if you send the goods before the expiry of the deadline. You shall bear the immediate cost for the return of goods. You would have to cover a possible loss in value only, if this loss in value can be attributed to dealing with the goods in a way which is not necessary to examine their nature, quality and functionality.

1. Definition of scope

For all orders via our online shop, the following terms and conditions shall apply.

2. Contracting parties, execution of contract

The contract of sale becomes effective with Emily&Joe's handmades & fabrics.

By making products available via the online shop, we make a binding offer regarding the creation of a contract in respect of these articles. Initially, you can place our products in the shopping cart without obligation and correct your entries at any time prior to making your binding order. Corrections can be done by using our designated and defined correction help in the order process. The contract will be executed once you accept the offer for the goods in the shopping cart by clicking the order button. You will receive a confirmation email immediately after sending your order.

3. Language of contract, storage of the contractual text

Contracts can be executed in either German or English. We will save the contractual text and send you the details of your order and our general terms and conditions via email. You can also view and download the general terms and conditions on this website at any time. You can view your previous orders via our customer login.

4. Terms of delivery

Shipping costs will be added to the product prices. Further details about the amount for the shipping costs can be found in the offer section. We only ship goods, a collection by the customer is not possible.

5. Payment

The following methods of payment are available in our shop:

Payment in advance
Should you select this payment method, we will send you a separate email with our bank details and deliver the goods after we have received your payment.

PayPal, PayPal Express

During the order process, you will be forwarded to the website of the online provider PayPal. In order to pay your invoice amount via PayPal, you have to be registered with PayPal or accordingly register first and authorise yourself with your access data and confirm the payment authorisation to us. After placing your order in the shop, we request PayPal to start the payment transaction.

The payment transaction will be done by PayPal automatically immediately after that. You will receive further details during the order process.

PayPal: Additional 0 percent of the purchase price will be incurred.
PayPal Express: Additional 0 percent of the purchase price will be incurred.

PayPal Plus
Within the scope of the payment service PayPal Plus, we can offer you different payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. On this website, you can enter your payment data and confirm the use of your data from PayPal as well as confirm the payment instruction given to PayPal.
If you selected PayPal as a payment method, you would have to be registered with PayPal Plus or accordingly register first and authorise yourself with your access data and confirm the payment. PayPal will execute the payment transaction immediately after confirmation of the payment instruction. Further information will be provided during the order process.

If you selected your credit card as a payment method, you would not have to be registered with PayPal in order to pay your invoice. The payment transaction will be done immediately after confirming the payment order and after you have authorised yourself as the legitimate card holder from your credit card company on request of PayPal and your card will be debited. Further information will be provided during the order process.

If you chose direct debit as a payment method, you would not have to be registered with PayPal to pay your invoice. By confirming the payment order, you are giving PayPal a direct debit mandate. PayPal will inform you about the date for the debit (so-called pre-notification). PayPal will instruct their bank to start the payment transaction by submitting the direct debit mandate immediately after confirmation of the payment order. The payment transaction will be done and your account will be debited. Further information will be provided during the order process.

Selecting a payment method through PayPal Plus will incur an additional cost of 0 percent of the purchase price.

6. Damage during shipment

Should your goods be delivered with obvious transport damages, please make your complaint about these damages at the earliest to the delivery agent and contact us immediately. Failure to file a timely complaint or get in touch with us does not have any consequences regarding your legal rights and the enforcement of claims, especially warranty rights. However, you will help us to claim our own rights from the carrier and the transport insurance respectively.

7. Guarantees and warranties

Unless anything else has been agreed explicitly, statutory warranty rights will apply. The limitation period for any claims arising from defects in used items shall be one year after the goods have been delivered. The above-mentioned limitations and reduction in time limits do not apply for claims due to damages which have been caused by us, our legal representatives or agents:

in case of injury to life, body or health,
in case of deliberate or gross negligent breach of duty as well as malice,
in case of a breach of fundamental contractual obligations, whose fulfilment is a prerequisite for enabling the proper fulfilment of the contract in the first place and in which the customer may normally trust (cardinal obligations)
in case of a promise of warranty, where agreed, or
to the extent that the Product Liability Act is applicable.

We always assume unlimited liability for claims regarding damages which have been caused by us, our legal representatives or agents

in case of injury to life, body or health,
in case of deliberate or gross negligent breach of duty,
in case of a promise of warranty, where agreed, or
to the extent that the Product Liability Act is applicable.
In case we, our legal representatives or our agents through slight negligence breach essential contractual obligations which are of a central significance for the achievement of the purpose of the contract and on which the contractual partner may regularly rely on, the liability will be limited to the damage which could be foreseen when concluding the contract and which can typically be expected to occur. Besides that, claims for damages are excluded.
